1. Introduction

By downloading or using the Application, these terms and conditions (Terms and Conditions) will automatically apply to you. You should read them carefully before using the Application.

The Application provides services to generate images from text prompts (Services). These Terms and Conditions grant you the right to use the Application within the scope defined herein.

You are not allowed to:

  • Copy or modify the Application, any part of it, or our trademarks.

  • Attempt to extract the source code of the Application.

  • Translate the Application into other languages or make derivative versions.

The Application, along with all trademarks, copyright, database rights, and other intellectual property rights, remains the property of Feraset Yazılım ve Danışmanlık A.Ş. (Feraset).

Feraset is committed to ensuring that the Application remains useful and efficient. We reserve the right to:

  • Make changes to the Application.

  • Charge for its services, but only with clear communication regarding payments.

The Application stores and processes personal data provided by users to deliver Services. Users are responsible for keeping their phones and access credentials secure. We strongly advise against jailbreaking or rooting your phone, as it may compromise security and prevent the Application from functioning properly.

2. Internet and Connectivity

Feraset is not responsible for the Application not working properly due to:

  • Internet connectivity issues (Wi-Fi or mobile data).

  • Data charges incurred while using the Application outside a Wi-Fi zone.

  • Roaming charges if you use the Application outside your home country.

By using the Application, you accept responsibility for any such charges. If you are not the bill payer for the device, we assume you have obtained permission from the bill payer.

Additionally, Feraset cannot be held responsible if:

  • Your device runs out of battery while using the Application.

  • The Application does not work at full functionality due to external factors.

  • You rely on third-party information provided via the Application, which may not always be updated in real-time.

3. Updates and Changes

Feraset may update the Application from time to time.

  • The Application is currently available on iOS and Android.

  • System requirements may change, and you will need to download updates to continue using the Application.

  • We do not guarantee that the Application will always work with all versions of iOS or Android.

  • You agree to accept updates when offered.

We may discontinue the Application at any time without prior notice. Unless otherwise stated:

  • Your rights to use the Application will end.

  • You must stop using and delete the Application from your device.

4. Changes to These Terms and Conditions

We may unilaterally amend these Terms and Conditions at any time.

  • You are advised to review this page periodically for changes.

  • Changes will be posted on this page and will take effect on the date of publication.

  • By continuing to use the Application after changes are published, you are deemed to have accepted the updated terms.

Important:
The User does not gain any representative or partnership status with Feraset by accepting these Terms.

These Terms and Conditions are effective as of 07.12.2022.

6. Feraset End-User License Agreement (EULA)

This agreement legally binds you, the User, and Feraset. By using the Application, you agree to the terms outlined here, including the Feraset End-User License Agreement and Privacy Policy.

6.1. Terms of Use

  • Feraset Yazılım ve Danışmanlık A.Ş. is a Turkish company providing mobile applications.

  • These Terms apply whenever you download, install, or use the Application or any related Feraset Services.

  • If you do not agree with these Terms, do not use the Application.

Your use of Feraset Services includes:

  • Accessing, installing, downloading, copying, or purchasing in-app content.

  • Complying with these Terms and all related policies.

If you continue using the Application after updates, you accept the updated terms.

7. Intellectual Property Rights

  • All rights to the Application, trademarks, and content remain with Feraset.

  • You may not reverse-engineer, decompile, modify, or create derivative works based on the Application.

  • You may not use Feraset’s intellectual property without permission.

If you upload content (e.g., synthetic voices or characters), you confirm that:

  • You own the rights or have permission to use such content.

  • You are responsible for any legal issues related to your uploaded content.

Feraset does not pre-screen user content but may remove content that violates these Terms or any applicable laws.

8. In-App Purchases and Payments

  • Some features require in-app purchases through Apple App Store or Google Play.

  • Payments are processed by these platforms, and their terms and refund policies apply.

  • Subscriptions automatically renew unless canceled.

Refunds:

  • If a purchase fails to download, Feraset will investigate and offer a replacement or refund via Apple/Google.

  • If you are under 18, you need parental approval for in-app purchases.

9. Termination of Use

Feraset reserves the right to:

  • Restrict or terminate your access to the Application without notice if you violate these Terms.

  • Disable accounts engaged in illegal or unauthorized activity.

  • Terminate the Application at any time without liability.

If your access is terminated:

  • You must stop using the Application and delete it from your device.

  • Feraset is not responsible for any data loss or damages caused by termination.

10. Warranty Disclaimer

  • The Application is provided "AS IS", without warranties of any kind.

  • Feraset is not responsible for:

    • Bugs, errors, or system failures.

    • Security risks (e.g., unauthorized access, cyberattacks).

    • Third-party services or content integrated with the Application.

Feraset reserves the right to remove content that is unlawful, offensive, or violates these Terms.

11. Force Majeure & Governing Law

  • Feraset is not liable for failure to perform obligations due to force majeure events (e.g., natural disasters, cyberattacks, regulatory changes).

  • These Terms are governed by Turkish law, and any disputes will be handled in Istanbul Courts.

12. Entire Agreement & Severability

  • These Terms constitute the entire agreement between the User and Feraset.

  • If any provision is found unenforceable, the remaining terms remain in effect.

  • No modification is valid unless in writing and signed by Feraset.

By continuing to use the Application, you confirm that:

  • You are at least 18 years old (or have parental consent).

  • You have read, understood, and agreed to these Terms.
